These Terms of Use govern your access to and use of this website, which is operated by the electric and plug-in hybrid vehicle dealership named in the contact panel below, at its premises in Orange County, Florida.

By using the site you agree to these terms. If you do not agree, do not use the site. Nothing here limits a right you have under the Florida Deceptive and Unfair Trade Practices Act, the federal Magnuson-Moss Warranty Act, the Federal Trade Commission Used Car Rule, the Florida Motor Vehicle Retail Sales Finance Act or any other consumer protection law that applies to your transaction.

These terms cover the website only. A vehicle purchase is governed by the signed retail buyer agreement and the accompanying documents you receive at the dealership, and by the Federal Trade Commission Buyers Guide displayed on the vehicle. Where a signed agreement conflicts with this page, the signed agreement controls.

This website is an information service. It describes our inventory, our battery testing method, our charging services, our trade-in approach, our delivery and export arrangements, and how to reach us.

This website has no forms, no account creation, no shopping cart and no online checkout. You cannot place an order, submit an application, reserve a vehicle, upload a document or join a callback queue here, because none of those features exist on these pages. Every transaction is completed with a human being, by telephone, by email, in person, or by post.

A listing on this site is an invitation to talk, not a binding offer. Prices, availability and specifications can change without notice, and a vehicle remains available until a signed agreement says otherwise.

We may change, suspend or withdraw any part of the site at any time, including a listing, a page or a feature. We do not guarantee that any page will remain available or that its content will remain unchanged.

You may use this site if you can form a binding contract and if you are not barred from doing so by law. Vehicle sales are made to adults who can sign for them, and a test drive or a delivery requires a valid driver licence and proof of insurance where we ask for it.

You agree not to use this site to break any law, to infringe anyone rights, to interfere with the site or the servers it runs on, or to obtain information about other customers.

You agree not to scrape, crawl, mirror or bulk-download the site, its vehicle data, its battery reports or its photographs without our written permission, and not to use automated means to place load on the site.

You agree not to misrepresent your identity, to impersonate another person, or to use information from this site to commit fraud, including title fraud, odometer fraud or the fraudulent sale of a vehicle you do not own.

We describe each vehicle from measurements, records and inspection, and we try to be exact. Even so, a listing is a summary, and it can contain a clerical error, an omission or a description that a photograph makes ambiguous.

Unless a listing says otherwise, prices shown exclude Florida sales tax, title and registration fees, dealer documentation fees, tag and transfer charges, delivery or transport charges, and any optional product you choose to buy. The figure you pay is the one written in the signed buyer agreement.

Photographs may show a vehicle before final reconditioning, may include accessories that are not part of the sale, or may be representative images of the same model and trim where noted. Colors can render differently on different screens.

Please verify anything you consider material before you buy, by telephone or in person, using the contact details below. We would rather answer a question twice than have you rely on an assumption.

Every electric or plug-in hybrid vehicle we offer is tested with a full charge and discharge cycle and cell-level logging. The battery health report we publish states the measured state of health, the per-module deviation, the capacity against the original rating, the DC charging curve and the date and method of the test.

A battery health report describes the condition of the pack on the day of the test. It is a measurement, not a prediction and not a guarantee of future capacity. Battery capacity declines with use, age, climate and charging habits, and can be affected by software updates and by a manufacturer diagnostic or replacement campaign.

Manufacturer battery warranties, which on most electric vehicles sold here run for eight years or 100,000 miles, are manufacturer obligations. They are not issued by us, they transfer with the car subject to the manufacturer terms, and any claim under one is made to the manufacturer through its authorised network. We will give you the manufacturer documents we hold and help you file a claim, but we cannot decide it.

Our own limited warranty coverage is separate from the manufacturer warranty, is stated in writing at the time of sale, and does not extend the manufacturer battery warranty or replace it.

Used vehicles are sold in the condition described in the signed agreement and in the Federal Trade Commission Buyers Guide for that vehicle. The Buyers Guide states whether the vehicle is sold with a warranty or as is, and it is part of your contract.

Except for the written warranty we give and any warranty that federal or Florida law implies and does not permit us to disclaim, the vehicle and this website are provided without warranties of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Where an implied warranty cannot be disclaimed under Florida law, or where the Magnuson-Moss Warranty Act applies to a written warranty we give, those rights remain yours and nothing on this page reduces them. We do not condition a warranty on the use of any particular brand of part or service unless the manufacturer requires it and the requirement is stated in writing.

No statement on this website, in a listing, in a photograph, in a message or in a conversation creates a warranty that is not also written in your signed documents.

We are not a lender, a bank or a credit broker acting on behalf of a lender. We refer you to lenders and finance companies, and you deal with the lender directly.

This website does not accept credit applications. A lender receives your credit application directly, obtains any consumer report it needs, and makes its own decision on approval, rate, term and down payment. Any figure discussed before approval is an illustration and not an offer, and it can change when the lender sees your application.

Retail instalment sales of motor vehicles in Florida are subject to the Florida Motor Vehicle Retail Sales Finance Act, and consumer credit is subject to federal law including the Truth in Lending Act and the Equal Credit Opportunity Act. Those laws govern the disclosures you receive from the lender and your rights if you are declined.

We may receive compensation from a lender for a referral, and we will tell you if you ask. That does not change the rate the lender offers you or the lender decision.

A trade-in appraisal is valid for the period stated on the written appraisal and only for the vehicle as presented. It is based on the condition, mileage, history and equipment we can verify on the day, and on the market for that vehicle at that time.

An appraisal given by telephone, by email or from photographs is provisional. It can change after inspection, and it will change if the vehicle has undisclosed accident damage, a branded or rebuilt title, an odometer discrepancy, an open safety recall, a mechanical fault, a warning light or equipment that is missing.

For an electric or plug-in hybrid trade-in, the appraisal depends on the battery health data we measure and on the vehicle history. If the battery has been replaced, if the state of health is below the level the vehicle reports, or if the pack is subject to an open recall campaign, we will say so and adjust the figure.

You confirm that you have the right to trade the vehicle in, that you have disclosed any lien on it, and that the information you give us about it is accurate. Title and payoff are settled before we take possession.

We plan home charging and we arrange the work through licensed electricians we have worked with before. The electrical installation itself is performed by that licensed contractor, not by us, and the contractor warrants its own work.

A charging plan we provide is advice based on what you tell us about your commuting distance, your parking and your electrical service. It is not an electrical inspection, and it does not replace the load calculation, the permit or the inspection that your jurisdiction and the contractor must complete.

We cannot guarantee that your electrical panel, service entrance or wiring will support a given charger, that a permit will be issued, that a utility or homeowners association will approve the work, or that an installation will be completed by a particular date. Where a limitation appears, we will tell you before you buy the vehicle rather than after.

Our separate Disclaimer describes the limits of charging and range information more fully, and it applies to this section as well.

We deliver nationwide and arrange export. Unless we agree otherwise in writing, delivery is made by an independent transporter, and the transport contract, the transit insurance and the delivery schedule belong to the transporter.

Vehicles travel at a partial state of charge, typically between 50% and 60%, because that range is what lithium-ion packs prefer for storage and transport. A vehicle will not arrive fully charged unless we agree that it will.

Risk of loss passes as stated in your signed agreement. Please inspect the vehicle at delivery and note any damage on the carrier documents before you sign for it, and tell us the same day so that we can help you pursue a claim.

If you export a vehicle, you are responsible for the destination country import rules, duties, taxes, homologation, charging standard compatibility and registration. We provide the documents we hold, and we can recommend an export agent, but we do not act as your customs broker and we do not guarantee that a vehicle can be registered in another country.

The text, layout, photographs, battery report formats, data compilations and code on this site belong to us or are used with permission, and they are protected by copyright and by other laws.

You may view the site, print a page for your own use and share a link. You may not copy, republish, resell, mirror or redistribute substantial parts of the site, or use our name, marks or photographs in a way that suggests an endorsement or a partnership, without our written permission.

Manufacturer names, model names and marks that appear on this site belong to their owners. We use them to identify the vehicles we sell. Nothing on this site implies that any manufacturer sponsors, approves or endorses us or our inventory.

If you believe material on this site infringes your rights, write to the postal address in the panel below with enough detail for us to identify the material and your claim, and we will respond promptly.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from your use of this site or from reliance on its content, including lost profits, lost opportunity, towing, rental, lost charging time or the cost of substitute transport.

We are not liable for a service outage, a corrupted file, a virus, an interruption in connectivity, or a loss caused by a third-party site we link to or by an embedded service that fails to load.

Where a vehicle transaction is concerned, our liability is limited by your signed agreement and by applicable law. Nothing in these terms limits liability for fraud, for a violation of a consumer protection statute that does not permit limitation, or for anything else that Florida or federal law does not allow us to limit.

Some jurisdictions do not allow the exclusion of certain warranties or damages. Where that is the case, the exclusions above apply only to the extent the law allows, and the rest of these terms remain in force.

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. The venue for a dispute arising from these terms or from your use of the site is the state or federal court with jurisdiction over Orange County, Florida, unless a consumer protection statute gives you the right to proceed elsewhere.

Before either of us files anything, we ask you to contact us using the details below and give us a reasonable chance to resolve the matter. A telephone call or an email resolves most disagreements faster than a filing does.

If a provision of these terms is found unenforceable, that provision is limited or removed and the remaining provisions stay in effect. A failure to enforce a provision on one occasion is not a waiver of it.

Any dispute about a vehicle, a warranty, a financing referral or a charging installation is governed by the signed documents for that transaction and by the law that applies to it, including the Magnuson-Moss Warranty Act and the Florida Motor Vehicle Retail Sales Finance Act where they apply. These website terms do not replace those rights.

We may revise these terms. The revision takes effect when it is published on this page, and the date at the top of the page changes with it. Your continued use of the site after a revision means you accept the revised terms.
